Terms of Service

This English text is a convenience translation. The official text of these terms is the Japanese version; if the two differ, the Japanese version prevails.

These Terms of Service (the "Terms") set out the conditions for using the publishing platform "BOOK://" (the "Service"), provided by J-Catalyst LLC (the "Company"). By using the Service, users agree to these Terms.

Article 1 (Scope)

  1. The Terms define the conditions of the Service and the rights and obligations between the Company and users, and apply to every aspect of the relationship between a user and the Company concerning the Service.
  2. Individual notices and guides the Company publishes within the Service (including How We Use AI and Copyright & Image Use) form part of these Terms.

Article 2 (Definitions)

  1. "User Content" means text, audio, photographs, images, documents, and any other information a user enters into or uploads to the Service.
  2. "Generated Content" means text, structural proposals, translations, and other output produced by the Service's AI features based on User Content and the user's instructions.
  3. "Publishing Data" means PDFs, EPUB files, Amazon KDP submission packages, and other export data created with the Service.
  4. "Plan" means a free or paid usage tier defined by the Company.

Article 3 (Accounts)

  1. Using the Service requires account registration. Users shall register true and accurate information.
  2. Users are responsible for managing their own credentials, such as passwords. Actions performed with an account's credentials are deemed actions of that account's user.
  3. Minors shall use the Service, and purchase paid Plans, only with the consent of a parent or legal guardian.
  4. Accounts may not be transferred, lent, or shared with third parties.

Article 4 (Fees and Payment)

  1. The Service is not subscription-based. Fees are one-time purchases per book (one project, or one language-and-market edition). Each Plan's contents and price are shown on the pricing page and the purchase screen.
  2. Payment is made via PayPal. Transactions are processed on PayPal's systems, and the Company does not obtain credit card numbers.
  3. Each Plan includes an AI generation allowance. Conditions for exceeding the allowance are shown on screen before purchase.
  4. Refund conditions for purchased Plans are as set out in the Legal Notice (Specified Commercial Transactions Act).

Article 5 (Content of the Service)

  1. The Service supports users in creating books from User Content, through AI-assisted structuring, drafting, text refinement, translation and localization proposals, and the creation of Publishing Data.
  2. Registration and publication on Amazon or any other sales platform is performed by the user, through the user's own account. The Company provides Publishing Data and instructions; it does not guarantee approval of publication, continued listing, or sales results.
  3. Responsibility for the content of the finished book rests with the user as its author. The Company does not warrant the truthfulness of the content on the user's behalf.

Article 6 (Rights in User Content)

  1. Copyright and other rights in User Content and in the finished book (including Generated Content) belong to the user. The Company acquires no such rights.
  2. The user grants the Company a license to use User Content only to the extent necessary to provide the Service (including storage on servers, on-screen display, format conversion, backup, and AI processing). This license does not extend to any purpose other than providing the Service.
  3. The Company does not use User Content to train AI models. Details are set out in How We Use AI.
  4. The user warrants that User Content does not infringe the copyright, portrait rights, or any other rights of third parties.

Article 7 (Review of Generated Content)

  1. Generated Content may contain errors or inaccuracies. Users shall review Generated Content themselves before adopting it.
  2. The final decision on whether Generated Content is included in the finished book is made by the user.

Article 8 (Prohibited Conduct)

In using the Service, users shall not:

  1. violate laws or public order and morals;
  2. infringe the copyright, trademark, portrait rights, privacy, or other rights of third parties;
  3. impersonate a third party, or create books designed to be mistaken for the works of real people or organizations;
  4. create or publish content that constitutes discrimination, defamation, or harassment;
  5. access the Service's systems without authorization or place excessive load on them;
  6. copy, resell, or re-provide the Service's features or data without the Company's permission;
  7. obtain AI generation allowances improperly, or use them for purposes other than intended;
  8. engage in any other conduct the Company reasonably judges inappropriate.

Article 9 (Suspension and Termination of Accounts)

  1. If a user violates these Terms, the Company may restrict use of all or part of the Service, or suspend or delete the account, without prior notice.
  2. The Company bears no liability for damage arising from such measures, except in cases of the Company's intent or gross negligence.

Article 10 (Withdrawal)

  1. Users may delete their account and withdraw from the Service at any time via the Service's settings screen.
  2. Withdrawal deletes project data. Purchased Publishing Data should be downloaded by the user before withdrawal.
  3. Fees for digital products already delivered are not refunded upon withdrawal. Treatment of undelivered portions follows the Legal Notice (Specified Commercial Transactions Act).

Article 11 (Disclaimer of Warranties; Limitation of Liability)

  1. The Company does not warrant that the Service fits any particular purpose of the user, or that expected results (including successful publication, sales volume, or revenue) will be achieved.
  2. The Company bears no liability for damage arising from interruption of the Service, loss of data, or unauthorized access by third parties, except in cases of the Company's intent or gross negligence.
  3. Where the Company is liable for damages, its liability is limited to direct and ordinary damage actually incurred by the user, up to the total fees the user has paid to the Company. This limitation does not apply in cases of the Company's intent or gross negligence, or where exclusion of liability is not permitted under the Consumer Contract Act of Japan or other applicable law.

Article 12 (Changes, Suspension, and Termination of the Service)

  1. The Company may change the content of the Service, or suspend or terminate its provision. In the event of termination, the Company will announce it within the Service with reasonable advance notice and endeavor to provide a period during which users can download their data.
  2. Temporary interruptions due to maintenance, failures, natural disasters, or other unavoidable causes may occur without prior notice.

Article 13 (Amendment of the Terms)

  1. These Terms may be amended in accordance with the provisions of the Civil Code of Japan on standard terms of contract. When amending, the Company will set an effective date and announce the changes and the effective date within the Service in advance.
  2. Use of the Service on or after the effective date constitutes agreement to the amended Terms.

Article 14 (Notices)

Notices from the Company to users are given by email to the registered address or by posting within the Service. Communications from users to the Company are made through the contact page.

Article 15 (No Assignment)

Users may not assign their position under these Terms, or any rights or obligations under these Terms, to third parties, or offer them as security, without the Company's prior written consent.

Article 16 (Severability)

If any provision of these Terms is held invalid or unenforceable under applicable law, the remaining provisions continue in full force and effect.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms are governed by and construed in accordance with the laws of Japan.
  2. Any dispute between the Company and a user concerning the Service shall be subject to the exclusive jurisdiction, in the first instance, of the court having jurisdiction over the location of the Company's head office.
